Rising Concern Over Client Account Irregularities
In recent years, there has been a noticeable rise in cases involving lawyers and client monies that result in criminal breach of trust (CBT). Insights from the Malaysian Bar’s Professional Indemnity Insurance (PII) Scheme reveal that, between 2020 and 2024, a total of 1,063 notifications were received. Of these, 15% involved allegations of breach of stakeholder duties or misappropriation, both related to client accounts.
These issues often do not arise from malicious intent but are the result of oversights, lack of internal controls, or inherited problems from previous firm arrangements. Even with the best intentions, lawyers may find themselves exposed to financial irregularities if proper safeguards are not in place.
The Importance of Proactive Risk Management
To prevent such situations, the Malaysian Bar urges practitioners to adopt a proactive approach. This includes:
- Regular transaction reviews and reconciliations
- Ensuring full transparency in financial matters
- Avoiding full delegation of financial supervision, even to trusted staff
- Establishing clear audit trails and identifying inconsistencies early
Such preventive measures not only protect lawyers’ reputations but also uphold public confidence in the legal profession.
Client Account Campaign: Strengthening Financial Accountability
The Client Account Campaign is designed to reinforce lawyers’ understanding of client money handling, in accordance with the Solicitors’ Account Rules 1990 and the Bar Council’s Rules and Rulings. Through this campaign, the Malaysian Bar will implement:
- Speaking engagements and educational videos
- Updated guidance materials and firm-wide pledges
- Posters, alerts, and visual reminders
- Plans for a whistleblower policy and a list of certified auditors
By targeting not just lawyers but also pupils in chambers and law students, the campaign seeks to build a foundation of ethical and responsible financial practices within the legal profession.
MyBar Risk Management Podcast: A New Digital Learning Tool
Complementing the campaign is the launch of the MyBar Risk Management Podcast, a monthly digital series that offers practical insights into risk management for legal practitioners.
Each episode, lasting 20 to 40 minutes, will cover topics such as:
- Law firm operations
- Legal liability
- Common risks in daily practice
The podcast will be available on YouTube, Spotify, Apple Podcasts, and shared via the Malaysian Bar website and Praktis, the Bar’s risk management portal. It is designed not only for lawyers but also for pupils, law students, and members of the public interested in professional legal standards.

The Malaysian Bar views these initiatives as a long-term investment in ethical legal practice. By encouraging risk-conscious behaviour and providing practical tools and guidance, the organisation aims to reduce professional vulnerability while enhancing public trust in the legal system.
